The terms governing use of Wireless Internet Services, Inc. services, customer responsibilities, billing, equipment, and service conditions.
What this agreement covers
These Terms of Service form an agreement between the customer and Wireless Internet Services, Inc. By ordering service or using equipment or services provided by Wireless Internet Services, Inc., you agree to comply with these Terms of Service and incorporated policies, including the Acceptable Use Policy.
Definitions and scope
Customer, user, service, and equipment refer to the subscriber, authorized users, services supplied by Wireless Internet Services, Inc., and hardware supplied for use with those services. The agreement is governed by applicable United States and California law. If a provision is found invalid or unenforceable, the remaining provisions remain in effect.
Customer responsibilities
Customers are responsible for accurate account and billing information and for the conduct of people who use the service or equipment through the customer account. Service is intended for the subscribed premises unless otherwise authorized. Customers must comply with these Terms and associated policies.
Service and support
Wireless Internet Services, Inc. will make reasonable efforts to provide reliable service and maintain company-provided equipment. Service may be interrupted or slowed by maintenance, upgrades, congestion, equipment issues, power failures, weather, disasters, or other conditions outside reasonable control. Technical support is provided for Wireless Internet Services, Inc. service and company-provided equipment; support for third-party equipment or software may be billable.
Availability and installation
Fixed wireless service depends on location, line of sight, distance, terrain, trees, interference, and other technical conditions. If service cannot be successfully provided at a location, company-provided equipment must be returned in good condition and applicable payments may be handled according to the service agreement.
Rates, billing and payment
Customers are responsible for monthly service charges, equipment charges, taxes, and other applicable fees. Rates and fees may change with notice as required. Accounts that become overdue may be subject to reduced service, suspension, disconnection, late charges, returned-payment fees, or reconnection fees.
Service term and cancellation
The term of service depends on the agreement selected when service is ordered. Contract and month-to-month services may have different cancellation requirements. Early termination charges may apply to contracted service. Customers remain responsible for charges through the effective termination date and for returning company-owned equipment.
Outages and credits
Wireless Internet Services, Inc. strives to maintain service, but not every interruption qualifies for a credit. Credits for qualifying outages are subject to the terms of the customer agreement and generally require timely notice to Wireless Internet Services, Inc. Interruptions caused by customer equipment, customer actions, maintenance, weather, disasters, malicious activity, or other excluded events may not qualify.
Customer equipment and home networks
Customers are responsible for devices, software, and home or business networks not supplied by Wireless Internet Services, Inc. Company support responsibility generally ends at the company-provided equipment. Customers may not share credentials or service outside the authorized household or business in violation of the Acceptable Use Policy.
Company-owned equipment
Equipment supplied by Wireless Internet Services, Inc. remains company property unless specifically sold to the customer. Customers may not sell, transfer, relocate, modify, tamper with, or encumber company-owned equipment without authorization. Charges may apply for damage, loss, unauthorized movement, or service calls caused by non-company equipment or unauthorized changes.
Limitation of liability
To the extent permitted by law, Wireless Internet Services, Inc. is not responsible for interruptions or losses caused by events outside its reasonable control. Liability relating to service or equipment is limited as described in the customer agreement, and the customer remains responsible for third-party claims arising from misuse of the service.
Entire agreement
These Terms of Service, the Acceptable Use Policy, the applicable work order or service order, and any other incorporated policies form the agreement between the customer and Wireless Internet Services, Inc. Changes may be made as permitted by the agreement and applicable law.
